In the event of a divorce or ending of a civil partnership you will need to make arrangements for the children involved (if any). Then best possible situation towards such cases involves both partners reaching an agreement. However, it is likely that they might not reach any such agreement as a result of which the services of family law solicitors may be needed.
Initially, family law solicitors rely on mediating between both parties in hopes of reaching common grounds. However, it is possible that even mediation might not work and matters may need to be taken to court.
Even though mediation is considered the first step towards reaching an agreement, it is not always necessary in certain situations. For example, if either partner had a history of physical and emotional violence then other party can approach the court directly without mediating. Once the court is approached then it will decide on the arrangements for the children which will include:-
- Where the children will live.
- When they will spend time with either parent.
- Who will be responsible for child maintenance?
The Special Issue Order:-
In certain situations you may need a special issue order to address certain issues related to your child’s upbringing. The mother, father or anyone else with parental responsibility can apply for this order.
